Cancellation and Refund Policy
This Cancellation and Refund Policy ("Policy") is an integral part of the Pera Sail Terms of Use. It outlines the rights, obligations, and financial consequences for both Guests and Hosts regarding the cancellation of confirmed boat rental bookings. By securing a booking on the Pera Sail platform, all parties agree to adhere to the terms set forth below.
1. Guest Cancellation Policy
Pera Sail implements a structured, tiered cancellation policy for Guests to ensure fairness to both the renting party and the Host who has reserved their vessel. The refund amount a Guest is entitled to depends strictly on the amount of advance notice provided prior to the scheduled embarkation date and time.
All cancellations must be initiated directly through the Pera Sail platform to be considered valid and time-stamped for refund calculation.

Note: "Days" refers to standard 24-hour periods calculated backwards from the agreed-upon local embarkation time.
2. Host Cancellation Policy
To maintain the integrity of our marketplace and ensure a reliable experience for Guests, Host-initiated cancellations are taken very seriously. If a Host cancels a confirmed booking for any reason other than documented Force Majeure or Severe Weather, the following procedures and penalties will apply:
- Guest Resolution: The Guest will immediately receive a 100% full refund of all amounts paid, including platform service fees. Alternatively, Pera Sail will offer priority assistance to help the Guest secure a comparable alternative vessel.
- Host Financial Penalties: A cancellation penalty fee (equivalent to 15% of the canceled booking value) may be deducted from the Host’s future payouts.
- Automated Review: An automated public review indicating that the Host canceled the reservation will be posted to the Host's listing.
- Platform Consequences: Repeated cancellations or "no-shows" by a Host will result in search ranking demotion and may lead to the temporary or permanent suspension of their Pera Sail account.
3. Force Majeure and Severe Weather Policy
Maritime safety is our highest priority. This clause supersedes the standard cancellation tiers in the event that sailing conditions become demonstrably unsafe or if unforeseen external events prevent the execution of the charter.
- Severe Weather: A booking may be canceled without penalty if local maritime or port authorities issue official warnings prohibiting navigation for the relevant vessel type, or if the designated Captain (provided by the Host) determines that weather conditions present an unacceptable safety risk. Standard rain or overcast conditions do not qualify as severe weather.
- Force Majeure: This includes unforeseeable, unavoidable events such as natural disasters, pandemics resulting in travel bans, acts of war, or sudden, unpreventable mechanical failure of the vessel immediately prior to embarkation (requiring documented proof from the Host).
- Resolution: In the event of documented Severe Weather or Force Majeure, the Guest and Host must first attempt to reschedule the booking to a mutually agreeable date. If rescheduling is impossible, the Guest will receive a 100% full refund, and no penalties will be applied to the Host.
4. Refund Processing Procedure
All eligible refunds determined by this Policy will be initiated automatically upon confirmation of the cancellation.
- Original Payment Method: Refunds will strictly be processed back to the original method of payment used at the time of booking.
- Payment Gateways: All financial reversals are securely routed through our authorized payment processors, Stripe or Montenegrin Bank Virtual POS, depending on the original transaction routing.
- Banking Timeframes: Once initiated by Pera Sail, please allow 5 to 10 standard business days for the funds to clear and appear in your account, depending on your banking institution's processing speeds and international settlement procedures.
