1. Acceptance of Terms
By accessing and using PeraSail ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
PeraSail is an online marketplace that connects boat owners with individuals seeking to charter yachts and boats. We provide the platform but are not party to the actual charter agreements between owners and renters.
3. User Accounts
3.1 Account Registration
To use certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your password
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
3.2 Account Eligibility
You must be at least 18 years old to create an account. By creating an account, you represent that you meet this requirement.
4. Boat Listings
4.1 Owner Responsibilities
Boat owners listing on PeraSail agree to:
- Provide accurate information about their vessels
- Maintain valid insurance and registration
- Ensure boats meet all safety requirements
- Honor confirmed bookings
- Maintain boats in good working condition
4.2 Listing Content
All listing content must be accurate, current, and not misleading. PeraSail reserves the right to remove any listing that violates our policies.
5. Bookings and Payments
5.1 Booking Process
When you make a booking, you enter into a contract with the boat owner. PeraSail facilitates the transaction but is not a party to the charter agreement.
5.2 Payment Terms
- 50% deposit required at booking
- Remaining balance due 30 days before charter
- All payments processed through PeraSail platform
- Prices displayed include our service fees
5.3 Service Fees
PeraSail charges service fees to both renters and owners. These fees are clearly displayed before booking confirmation.
6. Cancellations and Refunds
6.1 Cancellation Policy
Cancellation policies vary by listing. Standard policy:
- 60+ days before: Full refund minus service fee
- 30-60 days before: 50% refund
- Less than 30 days: No refund
6.2 Force Majeure
In cases of extreme weather, natural disasters, or other circumstances beyond control, alternative arrangements or refunds may be provided at PeraSail's discretion.
7. User Conduct
You agree not to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Post false or misleading information
- Harass or harm other users
- Attempt to bypass our payment system
- Use the platform for fraudulent purposes
- Interfere with platform operation
8. Insurance and Liability
8.1 Boat Owner Insurance
Boat owners must maintain comprehensive insurance covering hull, machinery, and third-party liability.
8.2 Renter Responsibilities
Renters are responsible for any damage caused during their charter and must have appropriate travel insurance.
8.3 PeraSail Liability
PeraSail acts as a marketplace platform only. We are not liable for the condition of boats, actions of users, or any incidents during charters.
9. Intellectual Property
All content on PeraSail, including text, graphics, logos, and software, is owned by PeraSail and protected by copyright and trademark laws.
10. Privacy
Your use of PeraSail is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Dispute Resolution
11.1 User Disputes
Disputes between users should be resolved directly. PeraSail may provide mediation assistance but is not obligated to resolve disputes.
11.2 Arbitration
Any disputes with PeraSail will be resolved through binding arbitration in accordance with international arbitration rules.
12. Modifications to Service
PeraSail reserves the right to modify or discontinue services at any time without notice. We are not liable for any modification or discontinuation.
13. Termination
We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting us.
14. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERASAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
16. Governing Law
These Terms are governed by the laws of Montenegro. Any legal action must be brought in the courts of Podgorica, Montenegro.
17. Severability
If any provision of these Terms is found to be invalid, the remaining provisions will continue in full force and effect.
